Court Papers Reveal Evidence in Worthington Toddler's Murder

The uncle accused of killing his niece told investigators he found his nephew jumping on the little girl's stomach just before he brought the unresponsive 2-year-old girl to the hospital. That's according to court documents obtained by KSFY Thursday.

Josue Fraga also apparently told Police the little boy quote did a "knee drop" on her. According to the complaint filed Thursday, shortly after the victim was pronounced dead a social worker and an officer came to the home where the victim and 5 other kids were living.

The complaint says Fraga and his wife brought the victim to Worthington Regional Hospital last Thursday morning. The victim, Samantha Fraga had a temperature of 84 degrees, was unresponsive, and pronounced dead 45 minutes later. The E.R. doctor found what he thought was evidence of extensive physical and sexual abuse and called police.

When he was interviewed, Josue Fraga said he left the home at 2:30 in the morning to pick up his wife from work and the two returned a few minutes later, then went to bed. Fraga says he woke up around 5:30 that morning and saw Samantha's three year-old brother do a "knee drop" on her.

That's when he told detectives he woke up his wife and they went to the hospital.

Neighbors like Gary Wagner say the new information is shocking. "A two year old being abused is bad enough, but to do all that is even worse. That's why I say we should have the death penalty."

According to the complaint, the doctor who performed the autopsy cast doubt on Fraga's story. The doctor says based on the victim's body temperature when she was admitted to the hospital, the victim would have died before 2:30. At that time, the defendant was the only adult with the victim.

Josue Fraga is scheduled to make his first appearance in court Friday morning in Worthington.

This family seems more concerned about defending an uncle rather than mourning the loss of an inocent life. Our hearts go out to this little one, & the police, hospital, & legal system personel that has to deal with this case firsthand.
