Sioux Falls construction worker, Brian Ebright, faces charges after he was arrested with more than a pound of marijuana in the parking lot of Lincoln High School.

Prosecutors say an assistant principal at Lincoln High suspected the 27 year-old was selling drugs out of his car, and called police. When the car was searched, detectives found the marijuana, a scale and meth.

Work on the expansion of the Lincoln High gym is moving along quickly. But as the expansion's taken shape, police say Brian Ebright was deep into drug activity in the school's parking lot.

Police had been watching him for some time. The Sioux Falls Police Department's Public Information Officer Loren McManus says, "And we weren't sure what it was. If he was simply just using it on the property, or if he was providing it to others. We didn't know for sure."

For days the police investigation hadn't turned up anything. And then information made police think Ebright was no longer on the site. That changed about 11:30 Monday. School officials tell KSFY they were aware police were looking for Ebright and his car, and when he showed up in the parking lot Monday they knew police were on their way.

A drug dog smelled drugs from outside the car and Ebright allowed officers to search inside where they found the drugs and scale. Ebright was a tender for S & S Masonry from Wagner.

His former co-workers, including Scott Robertson, said they were surprised by the accusations. "I just know he's just a tender here, he just works. For the most part I never really talked to him that much."

Golden Rule Construction Company is the General Contractor on the Lincoln High project. They wanted to make it very clear Ebright was not one of their employees. Ebright made his first court appearance Monday.

If he's convicted of all the charges against him, Ebright could face up to 45 years in prison. One of the owners of S & S Masonry told KSFY Ebright supplied the bricklayers with the materials they needed, and never did any work directly on the project.
