A former Mitchell social studies teacher denies allegations that he sexually and physically assaulted a student.

Andrew Tate says he should be released from a lawsuit that she's filed against the school.

Now in college, Brittany Plamp claims she was molested by Tate last year.

Plamp filed a lawsuit against the school district in January, and school lawyers later got a federal judge to add Tate as a

defendant.

The school district says it should not be held accountable for Tate's alleged actions, and that Tate violated the policy against

sexual harassment.

Tate denies any improper sexual advances or harassment of female students.

The former teacher and wrestling coach pleaded no contest last year to one count of stalking in a plea agreement in which

three other counts were dismissed.

Tate had been accused of stalking four high school girls.
