Protest Statement From Longview Farms Lawyer

KSFY News has obtained a statement from a lawyer representing the owner of the proposed hog farm that members of the Yankton Sioux Tribe are protesting near Wagner.  Dave Nadolski, of Lynn, Jackson, Shultz and Lebrun, P.C., represents Longview Farms.  The statement reads:

"Based on current information, we have advised our client, Longview Farms LLP to continue to build their CAFO on their land in Charles Mix County.  Until our client is ordered to stop construction by a Court that has jurisdiction over our client,  the land they are building on and the road they are traveling, construction of the facility will continue.  At this time, we believe that only SD State Court and US Federal Court have that jurisdiction."

Protesters have been at the site since yesterday, and more participants continue to arrive.  Tomorrow, a delegation of students from USD plan to protest at the site, and members of the South Dakota Peace and Justice Center are mobilizing as well. 

Meanwhile, South Dakota Attorney General Larry Long says law enforcement's role is simply to keep the peace at the site of a protest against a proposed hog farm west of Wagner.  Long says the dispute at this point is between the hog farm owner and his neighbors, so state government has no legal involvement other than making sure no breaks the law.

KSFY News has a crew at the scene and will continue to monitor the story.

In order to enter this hog farm, native lands have to be entered. To insult the tribe by asking if they didn't want to work shows the prejudice in your state. Course if the farm was placed in a totally "white" neighborhood that would changes things right?

What exactly will be the environmental impact of this farm on the water and air quality. How are the animals treated and are they fed hormones, anti-biotics etc.? I know it is hard to understand a life situation and culture different from your own, but please don't make judgments based on appearances. If I lived on this land, I would be protesting too. Would you hang your clothes out to dry in air that might be smelly and not safe environmentally? THINK about it. They have every right to protest

I am wondering why this wasn't addressed before the ordinance was passed to have the hog farm there. Are the protesters trespassing on the hog farmer's land? Also, it would add some much needed jobs in the area. Maybe it's time to stop drawing a government check if you don't want to work?
