Amy Dierks Hearing Wraps Up Friday Morning

A judge must now decide if evidence against a day care provider accused of shaking a baby will be allowed at trial. Friday prosecutors and defense attorneys in the Amy Dierks case were back in court arguing whether confessions Dierks gave to investigators should be allowed at her trial.

One of the major issues is a polygraph test.

Statements Amy Dierks gave are some of the statements lawyers on both sides continued to argue over Friday morning. Defense lawyers called Dr. Scott Bresler to the stand. Bresler said statements Dierks made about the injuries to 6 month old baby Henry Johnson during the polygraph test should have been followed up on more completely, immediatly after the test concluded.

Motions field by the defense team ask the judge to suppress all statements obtained by the police as a result of the questioning and interrogation of the defendant. Nine months after baby Henry was injured, people in Dierks neighborhood aren't saying much about the case. Karl Oehlke tells KSFY, "it really hasn't effected us, as far as still feeling safe in the neighborhood. Still feel safe overall."

The hearing wrapped up late Friday morning. Judge Brad Zell will issue a ruling later. Dierks is currently free on bond.

according to the argus leader "Police say Dierks shook 6-month-old Henry Johnson and slammed his head to the floor last November when she was providing day care for the boy." as if shaking him wasnt enough she thought she needed to slam his head onto the floor?? i dont think witch is the correct word! Imagine what she has done to her own children!! I hope she gets max punishment!!!!!!

Defense attorneys are something else. YOUR client seriously injuried a child, almost killing him. Who cares about her rights, she confessed, she did it, she's guilty. If she was innocent she wouldn't have done it. What about baby Henry rights to live. Amy can sit in jail the rest of her life for all I care.

I dont understand this women!! If you do the crime you have to do the time, and do the family a favor and own up to what you did to thier angel!! Set a good example for you children!! Dont confess and then try to take it back it doesnt work that way!!
