Sanford Memo On Initiated Measure 11 Leaked

KSFY obtained a confidential memo put out by attorneys for Sanford Hospital. It outlines how the abortion bill, Initiated Measure 11, if passed, would affect the types of treatment Sanford provides to pregnant women. We take a closer look at the document itself and what both sides are saying about it.

The internal memo is 10 pages long, and according to Mark Johnston, Vice President of Communications and Administration at Sanford, it was requested by Sanford CEO Kelby Krabbenhoft. Johnston says, "This product is not pro or against Initiated Measure 11, but it certainly factually lays out impact on Sanford Health."

The last line of the memo states, "Those instances where a pregnant woman faces uncertain, but potentially very serious health risks, Initiated Measure 11 will require a physician to choose between possibly committing a felony or subjecting a pregnant woman to a higher degree of medical risk."

Brandi Gruis, a representative from the Vote Yes for Life campaign say she has not read the document in its entirety, but adds that under Measure 11 physicians would be completely protected when trying to save the life of a mother. Gruis says, "Everything being done now at Sanford, when it's to protect the life and health of the mother, which is the only instances in which they do abortions, would be covered under Measure 11."

Johnston calls the memo straight-talking and unbiased and says as a matter of policy, Sanford will not weigh in on the debate. He says about 50 people got the memo, and they don't know who leaked it. Johnston adds that it's common for CEOs to request such an analysis when a change in legislation or public policy is proposed.

We also spoke with Jan Nicolay from the Campaign for Healthy Families. She says the Sanford memo reflects how complicated the language of the initiative is. Nicolay says it proves how complicated Measure 11 can make the doctor-patient relationship.

Initiated Measure 11 has all the safe-guards to protect women that the last attempt failed to have. This Measure protects women, doctors, and gives unborn children the God given right each one should have. If the mom does not want the child there are thousands of families currently trying to adopt a child and would give that child a loving home. That is something we could all agree on, why waste a beautiful creation of God when thousands would take them in. Think about that...

you're right...lots of people want to adopt. BUT you try carrying a child for 9 months and then give it away. so, a woman who is not able to care for, support or raise a child will be forced to make a decision to either give the baby up for adoption or give it an unstable home. it's a WOMAN'S choice. not the government.

sd voter I would think that it would be easier to live with the decision to give the child a chance to have a happy life with someone that wants to be a parent so very badly than to spend the rest of your life wishing you would have chose not to have your child killed so that it wont inconvenience you. so you're saying because you dont want to struggle with giving the baby up for adoption that you're just going to kill it? If you couldn't take care of your dog anymore would you just kill it? People should be more careful about their sex practices if they don't want children. Killing a child is murder. Once conception happens the cells are living and rapidly growing. Withing weeks are the development of heart and brain, and if you've seen Juno, it even has fingernails!

I'm a nurse. In nursing there is often more than one right answer, it is a matter of picking the BEST one. In this case, yes a woman should have a right to her body...however, a woman should NOT be able to choose to end the life of an innocent child. All actions have consequences, a consequence to unsafe sex is a baby--if you don't want one, don't have sex or use contraceptives. Once you make this choice and concieve you lose that "right" to youw own body--its not just yours anymore :)

lets think about the mother that is pregnant with twins and going into labor with both she might lose both babies where as terminating the one would let her keep the other... with death there is life! Under Measure 11 she loses both and who knows what happens to her. Lets think about that and trust in people that they will discuss with their doctors before they end the life of their babies and lets think about funding education so unwanted babies are not brought into the issue!!!
