Smoking Ban Gets Heated

When you're at a bar in South Dakota do you like to have a drink maybe light up some cigarettes?

Well soon it could be lights out for all South Dakota smokers.

"I don't think the government should have a right to tell me where I can and can't smoke," said Sioux Falls smoker and bartender Ed Mohr.

But supporters of the smoking ban say it's time to pass a state-wide ban because its already against the law to smoke in a public place in almost every state around South Dakota.

"There's a lot of people in the public that are looking for smoke free places, so they can go to a bar and have a couple of drinks and not come home smelling like an ashtray," said Darrin Smith of the American Heart Association.

He and other members of the South Dakota Tobacco-Free Kids network briefed legislators this week on a bill to ban smoking in all public places in South Dakota.

"We know that the debate on wether or not second hand smoke is dangerous for folks is over," said Jennifer Stalley of American Cancer Society. "The science is massive and conclusive that theres not a safe level for second hand smoke."

But back at the bar, smoker Ed Mohr says he should have a choice. "I feel its basically discrimination against smokers," he said.

He says its also going to impact his tips and his income because smokers will stop going to bars. "I won't go to a bar If I can't smoke," he said "I'll go to a bar, buy some beer and go home."

But supporters say most folks in South Dakota favor the ban, and they say soon smokers like Ed might have to find other places to light up.

So im reading that "non-smokers" shouldn't go into bars and places that smoke to avoid it...we shouldn't have to sacrifice our lives when we aren't the ones killing others...smokers have rights..yes..i agree..the right to smoke in their home, or their yard...but NOT around me or my family...if you would like to kill yourself than go ahead but leave the rest of us out of your poor choices..we choose not to smoke so why should we suffer as if we were a smoker?

Samson and Landon, you guys did a great job on your posts! You explain very well how disgusting the smoking habit is. Clean air and water is essential to life and health. I have read that children crawling on the floor in a smoker's house breathe arsenic and other toxic residue even when the smoker is not present, because the little innocents are so close to the floor where the particulate matter from the smoked cigarettes eventually settles. I saw the story on a national news site on the web.

This movement is more about the right to breath clean air than it is about the right to smoke. When one person exercises his "right" to smoke, there may be 30 others in the room whose right to breathe clean air is taken away. Clean air is God-given and was experienced the moment we were born. So what if the guy decides to take his smelly cigarettes home when his right to smoke in a bar ends. That's the POINT of the smoking ban! After the ban, smokers will still have the right to smoke at home.

Currently 110 million in Video Lottery Revenue. Ban smoking in Video Lottery establishments and this will go down. That's why Iowa made exceptions for their Casinos. Probably be what SD will do, if you have Video Lottery machines and majority of your income is from alcohol and lottery, smoking allowed. Do away with it in the resturants and any area food is served. How many beers does the Fryn' Pan sell anyways? There are loopholes in the current law that need to be closed.

To Landon: Yes the workers have rights, they have the right to quit. If you work in a bar then smoking is generally a part of the atmosphere there. While it is a choice to smoke (obviously) I hate the argument that "It's everyone's air" Correct. It is. And if the business you're in allows smoking, and you don't like it...leave. Or quit. But to completely ban something currently legal is never a good idea.

It sounds like our state is thinking about cutting programs for children and medicare etc. So is this a good time to spend money on this when the money and time spent on it could maybe used somewhere else?

im sorry to people who say that revenue will go down in the state...sorry to say but it wont! i lived in wyo and they had the ban and there was MORE business that was brought into the bars because the nonsmokers felt like they could come out and enjoy the bars without smelling gross! i agree with it and thats coming from a smoker...if your to lazy to step outside you should probably rethink smoking! :)

It is a disguisting habit and it is not discrimination against smokers, it another step towards better health. Also, I don't understand why this is such a shock to smokers. It's their choice to smoke, yes, and yes smoking is legal for individuals 18 years and above. I agree with those of you who say that smokers have rights to smoke, I believe that's an individual's choice - but everyone else has a right to LIVE and that right trumps your rights in regards to public places. It's that simple. The rights of the people around smokers, the WORKERS around smokers have rights too and frankly, the right to live is clear in the constitution as more important that rights to other things. Smoking is a pretty petty habit in comparison to someone's life.

One bar in the entire town of Brookings, SD no longer has smoking and guess what, they have actually seen a huge increase in business. Want to know why? With the short falls in revenue SD will be shooting them selves in the foot with banning smoking in bars, video lottery revenue will take a drastic hit and SD will have an even bigger shortfall in revenue. I believe it should be the individual bar owners choice as to whether or not to allow smoking. If I can't smoke, I don't go to that bar! If you don't want smoke, go to the nonsmoking bar. Well I feel its discrimination against non-smokers. It would be different if the smoke only affected the person smoking but it affects everyone there. I as a non-smoker should have a choice to go somewhere that offers non-smoking but what locations do that, not many!
