Son Of Former SD Governor Loses Prison Appeal

A federal appeals court says a judge acted reasonably when he ordered a South Dakota ranch couple to prison because they violated probation by not paying federal taxes.

The rulings by the 8th U.S. Circuit Court of Appeals upholds the sentences given to Randy and Mary Miller of New Underwood. Randy Miller is the son of former Governor Walter Dale Miller.

Randy and Mary Miller pleaded guilty in 2003 to federal tax charges for failing to pay taxes on their employees.

U.S. District Judge Charles Kornmann sent them to prison last year because they had failed to pay federal taxes after their
conviction.
