New DNA Testing Procedure On The Books For InmatesEffective Wednesday, South Dakota joined other states in setting up a system that lets prison inmates who meet strict conditions seek DNA testing that could prove them innocent. The new law limits DNA tests to a small number of inmates who have a real chance of being proven innocent by the genetic tests. Inmates requesting DNA testing now must state, under penalty of perjury, that they are innocent. Tests would be available only to those who have completed appeals in state and federal courts, and their cases would have to involve DNA that was not properly tested for some reason. Supporters of the new system said at least 202 people who were improperly convicted across the nation have been set free after DNA tests proved them innocent. © 2009 Associated Press.
