SD Trooper Asks to End Case Shooting Death Case

A South Dakota Highway Patrol trooper who killed a man after a chase near Harrold has asked a judge to decide a lawsuit filed by the man's fiancee before the case goes to trial.

Trooper Ryan Lantz shot Anthony LaRocco in October 2007 when LaRocco aimed a gun at short range at officers. Although it was a pellet gun, it closely resembled a .380-caliber semiautomatic pistol.

Lantz was later cleared of wrongdoing in the shooting.

Gerry Ogle, who had two children with LaRocco, alleges in her lawsuit that Lantz violated Larocco's constitutional rights by using excessive force to subdue him.

Lantz has filed a motion for summary judgment, which could end the court case.

What the officer suppose to do? He had a gun pointed at close range to him and fellow officers, was he suppose to say, wait let me see if this is a real gun?? If you're dumb enough to point a gun, real or not, at an officer who is armed, then you better be willing to deal with the consequences. Everyone knows what happens when you point a gun at officers anyways, geez!

Yes, law officers are armed and trained to shoot! If the LaRocco/Ogle "Darwins" cannot figure that out and test the system there is NO HOPE for them anyway!! wes
