A Military Magistrate has ruled that the army psychiatrist charged in one of the worst mass shootings on a U.S. military base will be held until trial. For now, Major Nidal Hasan will stay in a military hospital in San Antonio.
The hearing was to determine if Major Nidal Hasan will be kept under pre-trial confinement. Hasan's Attorney, John Galligan said "right now the magistrate has concluded that there was probable cause, he has made a determination that there was a basis for a commander to order someone into pretrial confinement."
The proceedings were held in his hospital room. Galligan also said, "there was no immediate need for the government, the prosecutors , the army to take the step of changing him from a patient to a pretrial confinee."
Hasan has been recovering from his wounds at the Brooke Army Medical Center in San Antonio, Texas. He was shot four times by police officers trying to stop the shooting rampage at Fort Hood on November 5th. Thirteen people died and 30 others were wounded in the attack.
Unheeded warning signs, including intercepted e-mails between Hasan and the radical cleric Anwar Awlaki, have triggered several inquiries. At The Pentagon Defense Secretary Robert Gates announced an investigation into extremism throughout the military. The 45-day review requires the services to probe how they can prevent any future incidents like the massacre at Ft. Hood. Other investigations include: the criminal probe, a review ordered by President Obama into what intelligence agencies knew, A Senate Judiciary Committee probe, and an investigation by the Senate Homeland Security Committee.
Hasan's attorney says Hasan has no feeling from the chest down and has limited movement in his arms. He has been told the paralysis is permanent. The hearing was closed to the media and officials at Fort Hood have declined to comment.
