Eric Robert pleads guilty in killing of correctional officer Ronald Johnson

Thru his attorney, Eric Robert has changed his plea to guilty to one count of first degree murder for the death of South Dakota Department of Corrections Officer Ronald Johnson.

According to the plea agreement, count 2, which was 1st Degree Murder-Felony Murder, and count 3, which was simple assault against Department of Corrections officer, were dismissed.

Robert says this decision was made on his own free will and is aware that the penalty for his actions is still potentially the death penalty.

When asked by the judge if Roberts understood his plea agreement that he just agreed upon, Robert stated, "it's been five months, more than enough time."

Robert waived his right to a jury sentencing him and asked that the judge decide his sentence.

Robert said he wanted to plead guilty the first day he was in court back in April.  "I want to make it clear that I did not want to think the court thought I just came to this decision."

Sentencing will begin the week of October 24th.  Jackley asked that the judge set aside a week for sentencing proceedings.
