A court date has been set for the man shot during a confrontation with a sheriff's deputy in rural Moody County.
59 year-old Robert Nosbusch of Pipestone will appear in Moody County Court on Wednesday, February 29 to face charges in the incident that lead up to the shooting.
The incident started around 11:30 Thursday, February 16. Nosbusch called 911 from his truck, saying he had been assaulted in Pipestone, Minnesota and was following the suspect at almost 90 miles an hour.
15 minutes later, both men approached a Sheriff's deputy on a rural Moody County road. Deputy Nathan Bowden stopped both vehicles. As he started instructing the men, Nosbusch got out of his pickup. He pulled a pistol from behind the back seat and pointed it at the deputy and the other man, Jay Christian, 51.
Deputy Bowden says he feared Nosbusch was going to shoot him or Christian, so he fired his own weapon six times, striking Nosbusch three times.
Nosbusch remains in a Sioux Falls hospital, but has been released from police custody on a personal recognizance bond. The terms of the bond state that he must remain a law abiding citizen, sign a waiver of extradition, not possess any weapons in the state of South Dakota, and show up for all court appearances.
Nosbusch is scheduled to be in court February 29, but if he is still in the hospital, another court date will be set at that time.
