No charges filed in fatal motorcycle accident

The Sioux Falls Police Department has determined that no charges will be field as a result of the fatal motorcycle crash on March 28.

The police department completed the reconstruction of the accident. The investigation revealed the motorcycle driver was unable to stop before colliding with a sport utility vehicle that was attempting to turn westbound on 26th Street from Edna Road.

The investigation determined the minimum speed of the motorcycle was 59 miles per hour. The collision occurred in a 45 mph zone. Ryan Sage, of the Minnehaha State's Attorney's Office noted that a driver loses the Right of Way when he or she is speeding.

"Based on that statute and speed involved here we determined it was appropriate to file no charges in regards to this incident on a criminal nature," Sage said.

Tony Johnson of Tea, SD was driving the motorcycle. He died at the scene as a result of his injuries. 

It was determined that drugs or alcohol were not involved with the accident.
