Attorney General: Healthcare decision threatens states

Posted: Updated:

South Dakota Attorney General Marty Jackley says the U.S. Supreme Court's ruling on healthcare violates the Constitution by threatening the States.

Attorney General Marty Jackley says he feels strongly that the federal takeover of healthcare goes too far in violation of fundamental individual and state's rights guaranteed by the Constitution.

He says he is disappointed that despite lawmakers' representation healthcare reform does not impose a tax. Jackley says a divided Supreme Court declares the Act as creating a constitutional tax.

"Today's decision now places this monumental issue back into the political arena for the voters to determine the future of their healthcare, and the importance of their individual and state's rights," said South Dakota Attorney General Marty Jackley.

However Attorney General Jackley says he is relieved the expansion of Medicaid was declared unconstitutional.
