The Charles Mix County State's Attorney's Office says two adults who live in the rural Wagner home where a 2-year-old girl's body was recovered are not being charged for the toddler's death.
KSFY news has now learned an 11-year-old boy is in custody as a suspect in the death of RieLee Ann Lovell.
Charles Mix County State's Attorney Pam Hein says two adults who live in the Wagner home are in custody on unrelated charges. She did not identify them.
The South Dakota Legislature passed a law earlier this year making it a felony for a parent or guardian to knowingly fail to report a dead child within six hours. Many state's adopted this law, calling it "Caylee's Law," after the high-profile case involving the delayed reporting of Caylee Anthony's death in Florida.
Hein says Caylee's Law could be implemented in this instance because a significant number of hours passed before police were notified of the toddler's death.
