Warrant for execution hearing set in Moeller case

PIERRE, S.D. (AP) - South Dakota Attorney General Marty Jackley says a warrant for execution hearing has been set in the Donald Moeller case for Wednesday in Sioux Falls.

Jackley has requested the execution date to be set within 90 to 120 days.

Moeller was convicted in the 1990 kidnapping of 9-year-old Becky O'Connell from a Sioux Falls convenience store, then raping and killing her.

Last month, the U.S. Supreme Court refused to hear his appeal. Moeller argued his conviction should have been overturned because the jury instructions weren't complete.

Moeller went on trial twice. He was convicted and sentenced to death in 1997. He says jurors weren't told he would not have been eligible for parole if he got a life prison sentence.
