Custer Co. Sheriff's Deputy won't face assault charge

CUSTER, S.D. (AP) - A Custer County sheriff's corporal who arrested the wrong woman last month won't face an assault charge.

Sheriff Rick Wheeler said Wednesday there was no evidence that deputy David Keale assaulted Susan Brown of Custer.

Keale is on administrative leave without pay. Wheeler says he's deciding whether to keep him on the force.

Brown says Keale approached her while she was shopping in Custer and told her she was being arrested for an outstanding warrant.

Brown says Keale wouldn't tell her what the warrant was for. It turned out to be for someone else.

Brown says Keale treated her roughly and shoved her onto a bench, and she thought she'd suffered a broken arm. She said the officer later apologized.
