South Dakota's Attorney General has filed the Warrant for Execution which requests a tentative date for the execution of Eric Robert.
Eric Robert killed Department of Corrections Officer Ronald Johnson on April 12, 2011 during a failed escape attempt. Robert pleaded guilty to First Degree Murder and waived the right to have the jury determine his sentencing.
Robert's original deaths sentence was scheduled for May, but it was postponed for Supreme Court to conduct a mandatory sentence review.
Last week the Supreme Court affirmed Robert's death sentence and Attorney General Marty Jackley filed a Warrant for Execution.
The State has requested Robert's execution to be the week of October 14-October 20.
A second inmate involved in the escape attempt also has pleaded guilty and been sentenced to death, but is appealing. A third inmate was given a life sentence.
