Sioux Falls shooter's girlfriend filed for restraining order

Sioux Falls police say having no prior record put the shooter in Tuesday's murder-suicide back on the street.

Several woman had restraining orders against Tuesday's shooter—Tyrone Smith, 38, of Sioux Falls. The restraining orders date back to 2009. Captain Greg VandeKamp, Investigative Services, said Smith's girlfriend filed for a restraining order Sunday night after Smith allegedly strangled her with his hands.

Smith was arrested Sunday night around 11:00. He was charged with one count of simple assault, domestic, and one count of interfering with a communication device.

VandeKamp said the mother of Smith's children filed a restraining order while Smith was in jail. VandeKamp said the mother and two children found another place to stay during the time of the protection order.

Smith appeared in court at 1:30 Monday afternoon and was released from jail five hours later. At Wednesday's press conference, Police Chief Doug Barthel said Smith had no prior convictions so he was released on a Personal Recognizance Bond.
