Arguments to begin in Berget case

Today arguments begin in the case of the State vs. Rodney Berget.

Berget pled guilty to the 1st degree murder of Senior Correctional Officer Ronald "RJ" Johnson. Judge Bradley Zell sentenced Berget to death in February.

During the hearing, the state will be looking at if the sentencing was constitutional or if it was excessive in comparison to other cases. But the South Dakota Supreme Court unanimously upheld the death sentence of Berget's partner in the failed escape attempt from the South Dakota State Penitentiary in April of 2011 that resulted in Johnson's death. Eric Robert is scheduled to be put to death sometime between October 14th and October 20th.

There will also be a hearing for Donald Moeller, the man who kidnapped, raped and murdered 9-year-old Becky O'Connel in Sioux Falls in 1991. His hearing is set for the 4th of October at 1:30 at the U.S. District Court in Sioux Falls. Moeller is set to be executed sometime between October 28th and November 3rd.
