Third party files motion to stop Donald Moeller execution

A third party has filed a motion to stop the execution of Donald Moeller based on South Dakota's lethal injection drug protocol.

South Dakota Attorney General Marty Jackley announced Friday that the Motion of Stay of Execution was filed Friday in Federal District Court. The Attorney General's office expects to file a response opposing the motion based in part that Donald Moeller is not recognized as a legal party of interest and that the motion lacks success on the merits.

Either way, Donald Moeller is expected to appear in court on the matter Monday, October 22, at 10 am at the Federal Courthouse in Sioux Falls.

Moeller is scheduled to be executed the week of October 28-November 3.
