SIOUX FALLS, S.D. (AP) - A lawyer for a death row inmate Donald Moeller says he does not want his execution stayed.
Moeller's lawyer Mark Marshall filed a motion Friday afternoon asking a federal judge to strike a request for a delay in his execution filed by a third party.
The motion's filing came immediately following a motion filed by a lawyer for Donna Nichols to halt the execution. Nichols claims she is a friend of Moeller, though it is not clear how she knows him. Attempts to reach her were unsuccessful.
Moeller is set to die by lethal injection sometime during the week of Oct. 28 for the rape and murder of 9-year-old Becky O'Connell.
A hearing in the case has been scheduled for Monday.
