A 26-year-old man is dead and another man is back in the state prison Friday, after a fatal drinking and driving crash in Sioux Falls.

Sioux Falls Police Spokesperson Sam Clemens said Thursday night just after a 2005 Mercury Montego crashed into a tree at the intersection of Oak Avenue and Holly Avenue in Sioux Falls.

A witness said the vehicle was traveling at an estimated 60 mph. The speed limit in the neighborhood is 25 mph.

Five people were in the vehicle and all were taken to a Sioux Falls hospital, where the driver of the vehicle died. Clemens said an investigation showed no one in the vehicle was wearing a seatbelt and speed and alcohol were a factor.

Clemens said the first officer who arrived to the scene said it looked like some people were trying run. One of the passengers actually ran from the scene, but other officers were able apprehend him 1 ½ blocks away from the accident. Clemens said the man ran because he was on parole. That man was taken to the hospital but ended up at the state penitentiary.

Police have not released a name of the victim or those involved in the crash. However, police did release the ages of the victims and where they lived.

The driver was a 26-year-old male from Sioux Falls. The front seat passenger was a 25-year-old male from Pierre. In the backseat were a 20-year-old male, 21-year-old female and a 23-year-old male, all from Sioux Falls. The 23-year-old male was the one who tried running from the scene.
