ACLU wants release of execution drug documents

SIOUX FALLS, S.D. (AP) - The American Civil Liberties Union is asking a federal judge to enforce his order requiring South Dakota's attorney general to provide documents related to drugs used in the October execution of Donald Moeller.

U.S. District Court Judge Lawrence Piersol late last year gave the state a deadline of Jan. 7 to provide the documents, including depositions, redacting information related to the manufacturer of the execution drug or pharmacist.

But Attorney General Marty Jackley says in filings that it's too risky to try to redact more than 1,700 pages of briefs. He says it's possible or even probable to miss references to the protected information sprinkled throughout.

ACLU of South Dakota executive director Robert Doody says the public deserves to know that the drugs are FDA-approved and came from legitimate sources.
