Mitchell man arrested again for more than 1 pound of marijuana

Two Mitchell men have been arrested for possession of marijuana—one of whom was arrested for the second time in less than two months.

On Tuesday, the James Valley Area Drug Task Force arrested Jared Nespor, 24, and Casey Nespor, 18, for possession of more than a pound of marijuana.

Jared was arrested for possession of marijuana- greater than one pound and possession of marijuana, greater than one pound with intent to distribute, and he was charged with violating a drug free zone.

Jared was arrested on January 23 when police caught him with more than five pounds of marijuana and various items of drug paraphernalia.

Casey was arrested for possession of greater than two ounces of marijuana and distribution of greater than one ounce of marijuana.

Possession of greater than 1 pound of marijuana is a class 4 felony punishable by 10 years imprisonment in a state penitentiary and a fine of $20,000. Possession of greater than 1 pound of marijuana with intent to distribute is a class 3 felony punishable by 15 years imprisonment in a state penitentiary and a fine of $30,000. Possession of greater than 2 ounces of marijuana is a class 6 felony punishable by 2 years imprisonment in a state penitentiary and a fine of $4,000. Distribution of greater than 1 ounce of marijuana is a class 5 felony punishable by 5 years imprisonment in a state penitentiary and a fine of $10,000.

Members of The Mitchell Police Division, The Davison County Sheriff's Office, The Sanborn County Sheriff's Office, The Aurora County Sheriff's Office, The Hanson County Sheriff's Office, The South Dakota Division of Criminal Investigation and The South Dakota Highway Patrol were involved with this investigation.
