The South Dakota Supreme Court is hearing a worker's comp appeal from a murder case.
On Christmas Eve in 2008, Steve Tassler killed his wife Julie in the employee parking lot of HSBC in Sioux Falls before shooting and killing himself.
Family attorneys are seeking worker's comp for the incident.
They say Steve knew when HSBC allowed Julie time for a break and where her parking spot was.
The appellants say those factors facilitated the murder. Dean Nasser is the appellants' attorney. "Given the fact that the assault was shown unlikely to occur when Julie was with the children and work was the only time she wasn't with them, especially during this critical 24-48 hour period, Julie's work provided the only isolated access to Julie before cooling off."
The Tasslers left behind two kids.
If the Supreme Courts rules in their favor, they'll receive money to cover funeral and burial costs.
They will also receive two-thirds of Julie's weekly wage until they turn 18 years old.
