Convicted murderer Rodney Berget to be executed

An execution date has been set.

Monday, a judge issued a warrant calling for Rodney Berget's death.

The state convicted Berget of murdering correctional officer Ronald "RJ" Johnson during a failed prison escape.

The time has been set.

In just about six months, the court scheduled Berget to be executed during the week of Sunday, January 12th through Saturday, January 18th.

Berget attempted to appeal his death sentence.

But in May, a judge denied his request for a new hearing, and again sentenced him to death.

Once it's actually scheduled, the warden will announce the exact date within 48 hours of execution.

As for witnesses for the execution, the law allows for someone from RJ Johnson's family to be present.

State law calls for Berget's trial judge, the state's attorney along with the county sheriff.

And South Dakota attorney general Marty Jackly, who made the announcement Monday that a warrant was issued for Berget's execution.

Berget is one of three men convicted in the death of correctional officer RJ Johnson.

Eric Robert was executed for his role in Johnson's death in October.

And Michael Nordman received a life sentence for supplying the murder weapons.
