Attorneys for Lynette Johnson, have filed paperwork in a lawsuit against the state.
Johnson is the widow of correctional officer Ronald "R.J." Johnson who was killed in the line of duty by Rodney Berget and Eric Robert during a failed prison escape attempt.
KSFY News spoke with Johnson's widow this afternoon about why did she decide to file this civil suit.
As you can understand, Lynette was very emotional talking about this case.
She told me she's doing this for one reason and one reason only, and that's for R.J.
She believes the people responsible for her husband's death need to be held accountable.
Lynette Johnson said her husband's death is something which should never have happened.
She told me it's been two-and-a half years and it still feel like yesterday.
And court documents tell why Johnson holds the State, the Department of Corrections and others responsible for the events which led to her husband's murder.
She calls it devastating and shocking.
Court documents state that on the day Ronald Johnson was killed, maximum security inmates in West Hall allegedly were not subject to direct supervision during their inmate activities.
And that those inmates pushing a laundry cart or doing recycling duties would not have been supervised.
The documents also state an inmate in the state pen named Tim Henry had raised several red flags about Eric Robert and Rodney Berget.
He reported his suspicions about Berget and Robert's plan to escape, yet he was told his information was no good.
And overall, henry believed Robert and Berget knew how to work the system and the system allowed it to happen.
