The man accused of killing Sioux Falls toddler Tyrese Ruffin is out of jail tonight.
The two-year-old died earlier this month from injuries sustained while in the care of Joseph Patterson.
KSFY News spoke with the Lincoln County state's attorney to get his reaction to Patterson's release.
Monday afternoon, Lincoln County state's attorney Tom Wollman argued his concerns about Patterson being let out in the community.
But then a judge lowered his bond.
And less than 24-hours later, his family paid his bail.
Joseph Patterson is out of jail. The price of freedom, $750,000 in cash, paid in full.
"We sought a million dollar cash bond, the judge lowered that and I'm respectful of that. the judge was charged with the duty of evaluating the facts and circumstances that were in front of him yesterday, and he made his decision based upon that and we respect that," Wollman said.
But with Patterson's police record, Wollman told the judge he had concerns.
"We argued yesterday that based upon the filings that we had in this office last year, alleging a simple assault domestic charge, as well as the assault against the minor child, that he present a potential risk to the community," Wollman said.
And that's not the only risk that concerned Wollman about Patterson.
"It was our argument, that based upon the extent of the potential penalties in this case that he is a potential flight risk," Wollman said.
But considering Patterson's family put up $750,000 cash to release him, Wollman believes Patterson will show up for his day in court.
"We're confident that he'll be here to face these charges. Again based upon the representations of defense council coupled with the significant cash bond that's been posted in this case," Wollman said.
Patterson faces several charges including second degree murder, first degree manslaughter, aggravated battery of an infant and abuse or cruelty to a minor.
Patterson has a pre-trial hearing on January 13, 2014.
