Plea change set for man acquitted of killing child

Posted: Updated:

WATERTOWN, S.D. (AP) - A Watertown man acquitted of killing his girlfriend's toddler plans to plead guilty to at least one new charge in order to avoid another trial.

A motions hearing scheduled Wednesday for Jay Barse has been switched to a change of plea hearing.

The state's attorney says she has reached an agreement with Barse but it hasn't been signed, so she can't say what he plans to do. Barse's lawyer also confirmed there's an agreement.

Barse earlier pleaded not guilty to four counts: child abuse involving a victim younger than 7, two counts possession of a controlled substance and keeping a place for use or sale of controlled substance.

A jury found him not guilty Nov. 4 of murder and manslaughter for the March death of his ex-girlfriend's 14-month-old daughter.
