Valley Springs man convicted of raping child get new trial

PIERRE, S.D. (AP) - The South Dakota Supreme Court has ordered a new trial for a Valley Springs man convicted of raping a 6-year-old girl.

The high court says Kevin Buchholtz is entitled to a new trial because improper evidence was allowed in his first trial last year. The justices say an expert witness was improperly allowed to give testimony that bolstered the girl's credibility.

Buchholtz was convicted of two counts of first-degree rape, one count of sexual contact with a child and one count of indecent exposure. He was sentenced to 60 years in prison.

Defense attorneys argued that Buchholtz was innocent, but prosecutors said there was no reason the 6-year-old girl would make up a story about Buchholtz assaulting her.
