New video surfaces in SD bicyclist-motorist spat

Posted: Updated:

SIOUX FALLS, S.D. (AP) - A judge wants to review video evidence before deciding on a plea deal for a Sioux Falls man accused of swearing and honking his horn at a bicyclist and pushing him into traffic with his pickup.

The case surfaced after bicyclist Joe Stiller snapped a photo of driver Joshua Schroeder last April and posted it on Facebook.

The 39-year-old Schroeder has agreed to a plea deal in which reckless driving and simple assault charges will be dropped in exchange for him pleading guilty to following too closely. Defense attorney Jeff Larson says a gas station video shows that Stiller exaggerated what happened.

The 50-year-old Stiller says the incident terrified him and he thinks the initial charges are appropriate.

Judge John Schlimgen wants to review the gas station video.
