Judge rules Spellerberg Park pool ballot mistake stays

A judge has ruled against members of the groups Save Spellerberg and Citizens for Integrity.

The community organizations wanted the city to fix a mistake made on the ballot for the vote on an outdoor pool at Spellerberg Park.

There's that expression they gave it the good fight and I would say that applies to the neighbors and community members who decided to take this battle to court.

Initiated Measure 2 asks voters if a new outdoor pool should be built at Spellerberg Park.

The ballot should state that the pool would be completed here by December 31, 2015 but instead it reads December 15, 2015.

The neighborhood group save Spellerberg hopes voters will vote yes Tuesday on ballot measure 2.

They want to replace the old pool with a new one, and prevent an indoor pool from being built.

The ballot lists an incorrect timeline that's off by about two weeks. The group Citizens for Integrity wants a correction so they took their concerns to court.

But the judge ruled the ballot stays. The neighbors are obviously disappointed but they're taking it in stride.

Citizens for Integrity spokesman Bruce Danielson said "every one of us that was in the whole Save Spellerberg group, be it sun, be it snow gates, everyone of these groups that has been involved in this thing we're all just average citizens, we don't know election law."

"After today, I feel more satisfied about a lot of things going on because now we've put the city on notice that the average citizen in Sioux Falls isn't just going to sit back and let the abuses of the system move forward," Danielson added.

Even though it may seem like a difference of only two weeks, many of those hoping the judge would have ruled in their favor believe accuracy matters.

A yes vote on initiated ballot measure two means you approve of a new outdoor pool at Spellerberg Park. A no vote means you're against the outdoor pool. Some who are against the outdoor pool believe an indoor pool would get more use.
