Rapid City man sentenced for using 2-year-old as a shield

Posted: Updated:

KOTA -- The man who used his 2-year-old daughter as a shield to avoid being arrested will spend nearly two decades in prison.

Tuesday, Seventh Circuit Judge Robert Gusinsky sentenced Virgil Bald Eagle, 37, to 20 years behind bars for second degree kidnapping.

Prosecutors and Judge Gusinsky both say Bald Eagle is a violent person. His criminal history and latest conviction for kidnapping and assault echo that sentiment. During Bald Eagle's trial last month, law enforcement testified that Bald Eagle held his terrified daughter against the door and told police that if they tried to get in they'd hurt his daughter. Police were able to get in, rescue the girl and arrest Bald Eagle without anyone getting seriously injured.

Bald Eagle was drunk at the time. His attorney, Matt Stephens, argued that Bald Eagle is not a violent person, and only creates problems when he is drunk.

Bald Eagle was also sentenced to 5 years on two separate simple assault on law enforcement charges.
