Save Our Neighborhood group takes land annexation to South Dakota Supreme Court

Voters cleared the way for a new Wal-Mart in southern Sioux Falls on April 8, but the issue is facing yet another legal challenge from the Save Our Neighborhood group.

South Dakota’s Supreme Court heard arguments today in a case filed by the Save Our Neighborhood group last August. The group says the City of Sioux Falls violated the law when it annexed the property at 85th Street and Minnesota Avenue, where the new Wal-Mart is slated to be built.

The annexations should have been approved by Lincoln County, Ron Parsons, attorney for Save Our Neighborhood, told KSFY News. Sioux Falls City Attorney James Moore says the city has been following the annexation statute.

The reversal Save Our Neighborhood is seeking “would invalidate the annexation,” Parsons said.

Wal-Mart says it has made several changes to make the planned store a better fit for the neighborhood, and that the store has supporters in the community.
