Rodney Berget heading back to court

Rodney Berget has admitted guilt in the 2011 murder of Corrections Officer Ronald "RJ" Johnson.

He's been sentenced to death for that murder twice now.

But, he's expected in South Dakota Supreme Court at the end of May.

South Dakota's Attorney General, Marty Jackley said having two sentences is not rare, and other death row cases have been through the same process.

He added they take the process very seriously, so they want to make sure the defendant gets a full due process -- so it's the right sentence to fit the crime.

But Jackley said Berget's hearing at the end of may will be an appeal over Berget's second death sentence.

There will be oral arguments over a couple of topics from the last trial.

Jackley said there's an issue with a psychological report and Berget's "long-lost-son."

Jackley said part of the hearing will be how broad the scope will be of what's being argued.

"Our view is that these matters have already been litigated both at the trial level and frankly some of them already at the South Dakota Supreme Court that he's received due process and a fair sentence," said Jackley.

If the death sentence is upheld, Jackley added there's still a process on the state and federal side to address any constitutional concerns.
