Federal judge dismisses portion of Lynette Johnson's wrongful death suit

A federal judge dismissed a portion of the wrongful death lawsuit filed against the South Dakota Department of Corrections.

Lynette Johnson, wife of Ronald ‘RJ’ Johnson, filed the lawsuit after her husband was murdered by two inmates in 2011.

Rodney Berget and Eric Robert murdered Johnson in April 2011 during an unsuccessful escape attempt. Robert was executed for the crime in October 2012. Berget remains on death row.

Although the federal portion of Johnson’s lawsuit was dismissed, five of the lawsuit’s claims will be addressed by a state court.
