Judge grants city's motion to dismiss in building collapse lawsuit

SIOUX FALLS, S.D. (KSFY) - A judge has dismissed a lawsuit against the city of Sioux Falls involving the Copper Lounge building collapse.

Court documents state that the city's issuance of a building permit to Hultgren Construction did not create a duty of care to support a negligence claim and plaintiffs cannot establish the city owed them a special duty of care, ruling in favor of the city's motion to dismiss.

Hultgren Construction was renovating the building at the time of the collapse.

Emily Fodness and her family sued the city of Sioux Falls, claiming it should be held responsible for her injuries from the building collapse in 2016.
